Welcome to this website, a service of K2 Software, Inc. and its subsidiaries, the maker of K2 software (collectively, "K2" or “K2”).

This policy describes the privacy practices used on this website and with information collected by or provided to K2 (“Privacy Policy”). By using the K2 website, you expressly consent to the processing of information as described in this Privacy Policy. If you do not agree with this Privacy Policy, please do not use the K2 website.


What kind of Personal Data do we collect from our website?

Derivative Data
Information our servers automatically collect when you access the Site, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing our sites or services. [If you are using our mobile applications, this information may also include your device name and type, your operating system, your phone number, your country, and other interactions with the application via server log files, as well as any other information you choose to provide.

Financial Data
Financial information, such as data related to your payment method (e.g. bill-to information, purchase order number, valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services from the Site. 

Personal Data
“Personal Data” is defined as information that identifies a particular person.  K2 collects two types of personal information from this website:

(1) information voluntarily supplied by visitors to and users of the website, and
(2) tracking information recorded as visitors and users navigate through the website. Some of this information is Personal Data (for example, your name, address, telephone number, and e-mail address).

To make use of some features on our website, visitors and users need to register and provide certain information as part of the registration process. We may ask, for example, for your name, e-mail address, street address, zip code, and company name.

The information you supply may be needed to complete the particular function of the website you are interacting with or may help us to offer you more personalized features, to make the website more useful to you. If you choose, our systems will remember some of this information the next time you log in and use our website by installing a cookie on your computer.

The more you tell us about yourself, the more value we can offer you. Supplying this information is entirely voluntary. When you submit any Personal Data over this website, K2 (i) may use the information for the purposes described at the time you submit it and (ii) with your consent, may use the information to contact you to make you aware of other products and services of interest. Of course, if you want to remain completely anonymous, you're still free to take advantage of the publicly available content on our website without registration.

To help make our website more responsive to the needs of our users and visitors, we use a standard feature of browser software called a "cookie." K2 uses session-based cookies to track the pages on our website visited by our users. We can build a better website if we know which pages our users are visiting and how often. Certain non-personal data about visitors to this website is recorded. This information is used primarily to tailor and enhance visitors' experience using the website. We may use this information in an aggregate, non-identifiable form to, among other things, measure the use of our website and determine which products and sections are the most popular with website visitors.


To make our website more valuable to our visitors, we may offer some features in conjunction with other companies. What other kinds of Personal Data do we collect? K2 also collects Personal Data throughout the course of its normal day-to-day activities, as needed to provide its services. Some examples of these types of collections could be for business related purposes, such as billing, and services delivery; or to provide promotional and direct marketing offerings, such as tradeshow registrations or trial services. Information provided for these services will only be used for the purposes indicated, or in order to provide the expected service or promotional notifications.


We respect your privacy and consider the Personal Data you provide to be confidential. Information provided to us is securely stored within our information systems with limited access provided to approved K2 employees. K2 may disclose Personal Data to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock.

In order to serve you more effectively, we may sometimes disclose Personal Data about you to our affiliates, subsidiaries, service providers or to others who work for us, or in response to subpoenas, court orders or legal process, or to establish or exercise our legal rights or defend against legal claims. K2 is headquartered in the United States and your Personal Data may be transferred to our servers in that country or to another country that may not necessarily have data protection laws as protective as those in your country. By providing data to the K2 website, you expressly consent to such transfers of your data to the United States or other countries. Our collections, storage and use of the Personal Data will be governed by the practices mentioned in this Privacy Policy. K2 ensures that the rights of individual are adequately protected by itself and its subsidiaries. We will retain your Personal Data for the period necessary to fulfill the purposes outlined in this Privacy Policy unless a longer retention period is required or permitted by law.


You may choose to opt-out of receiving promotional e-mails about Source Code’s products and services by following the ‘un-subscribe’ procedures within the email or by emailing us at privacy@k2.com


We have implemented commercially reasonable organizational, technical, and administrative measures to protect Personal Data within our organization, including security controls to prevent unauthorized access to our systems. While we take reasonable steps to secure your Personal Data from loss, misuse, interference and unauthorized access, modification and disclosure, you should be aware no security procedures or protocols are ever guaranteed to be 100 percent secure from intrusion or hacking, and there may be some risk assumed when sharing Personal Data online.


You may review and change information that you provide to us through this website by logging into your account and updating your profile information. You may also change your preferences related to email communications within your profile. To request access, correction, deletion or receive a copy of your Personal Data, follow the applicable instructions below to contact us. While we will make reasonable efforts to accommodate your request, we also reserve the right to reject such access requests or to impose certain restrictions and requirements on such requests, if required or permitted by applicable law. We will respond to your request within a reasonable time frame. If we cannot honor your request within a 30-day period, we will tell you when we will be able to provide access. In the unlikely event that we cannot provide you access to this information, we will explain why we cannot do so.


Source Code’s website and services are not directed to individuals under the age of 18 and K2 does not knowingly collect or maintain Personal Data of individuals under the age of 18. If you become aware that an individual under the age of 18 has provided us with Personal Data, please notify us at privacy@k2.com. If we become aware that someone under the age of 18 has provided us with Personal Data, we will take appropriate measures to investigate and address the issue promptly.


In addition to data that is collected and controlled by K2, there are users of our K2 Cloud service that maintain the ability to store data created during the use of the SaaS product within their cloud instances in Azure. Customers of K2 Cloud retain all effective control of their data that is provided to, or linked from, their K2 Cloud service.

As K2 does not control this data and has very limited access for supporting purposes only, any requests for corrections, deletion or copies of data should be directed to the K2 Cloud customer (the data controller). End users should contact the K2 Cloud customer directly with any questions on the method in which their data is processed using the K2 Cloud solution.


California Privacy Rights
California Civil Code Section 1798.100, also known as the “California Consumer Privacy Act” permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

If you are under 18 years of age, reside in California, and have a registered account with the Site [or our mobile application], you have the right to request removal of unwanted data that you publicly post on the Site. To request removal of such data, please contact us using the contact information provided below, and include the email address associated with your account and a statement that you reside in California. We will make sure the data is not publicly displayed on the Site, but please be aware that the data may not be completely or comprehensively removed from our systems.


Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.


We review our Privacy Policy at least annually and may make changes to this Privacy Policy from time to time. If we make material changes to this Privacy Policy, we will notify you either by posting in a noticeable location on our website or by directly sending you a notification.
