What other kinds of Personal Data do we collect?
SourceCode also collects Personal Data throughout the course of its normal day-to-day activities, as needed to provide its services. Some examples of these types of collections could be for business related purposes, such as billing, and services delivery; or in an effort to provide promotional and direct marketing offerings, such as tradeshow registrations or trial services. Information provided for these services will only be used for the purposes indicated, or in order to provide the expected service or promotional notifications.

HOW SOURCECODE MANAGES YOUR PERSONAL DATA

We respect your privacy and consider the Personal Data you provide to be confidential. Information provided to us is securely stored within our information systems with limited access provided to approved SourceCode employees. SourceCode may disclose Personal Data to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock.

In order to serve you more effectively, we may sometimes disclose Personal Data about you to our affiliates, subsidiaries, service providers or to others who work for us, or in response to subpoenas, court orders or legal process, or to establish or exercise our legal rights or defend against legal claims. SourceCode is headquartered in the United States and your Personal Data may be transferred to our servers in that country or to another country that may not necessarily have data protection laws as protective as those in your country. By providing data to the SourceCode website, you expressly consent to such transfers of your data to the United States or other countries. Our collections, storage and use of the Personal Data will be governed by the practices mentioned in this Privacy Notice. SourceCode uses EU approved standard contractual clauses between its subsidiaries, affiliates and service providers to ensure that the rights of individual are adequately protected. We will retain your Personal Data for the period necessary to fulfill the purposes outlined in this Privacy Notice unless a longer retention period is required or permitted by law.

SECURITY

We have implemented commercially reasonable organizational, technical, and administrative measures to protect Personal Data within our organization, including security controls to prevent unauthorized access to our systems. While we take reasonable steps to secure your Personal Data from loss, misuse, interference and unauthorized access, modification and disclosure, you should be aware no security procedures or protocols are ever guaranteed to be 100 percent secure from intrusion or hacking, and there may be some risk assumed when sharing Personal Data online.

HOW YOU CAN MANAGE YOUR PERSONAL DATA

You may review and change information that you provide to us through this website by logging into your account and updating your profile information. You may also change your preferences related to email communications within your profile. To request access, correction, deletion or receive a copy of your Personal Data, follow the applicable instructions to contact us below. While we will make reasonable efforts to accommodate your request, we also reserve the right to reject such access requests or to impose certain restrictions and requirements on such requests, if required or permitted by applicable law. We will respond to your request within a reasonable time frame. If we cannot honor your request within a 30-day period, we will tell you when we will be able to provide access. In the unlikely event that we cannot provide you access to this information, we will explain why we cannot do so.

INDIVIDUALS UNDER THE AGE OF 18

SourceCode’s website and services are not directed to individuals under the age of 18 and SourceCode does not knowingly collect or maintain Personal Data of individuals under the age of 18. If you become aware that an individual under the age of 18 has provided us with Personal Data, please notify us at privacy@k2.com. If we become aware that someone under the age of 18 has provided us with Personal Data, we will take appropriate measures to investigate and address the issue promptly.

DATA STORED IN OUR MANAGED CLOUD INSTANCES

In addition to data that is collected and controlled by SourceCode, there are users of our K2 Cloud service that maintain the ability to store data created during the use of the SaaS product within their cloud instances in Azure. Customers of K2 Cloud retain all effective control of their data that is provided to, or linked from, their K2 Cloud service.

As K2 does not control this data and has very limited access for supporting purposes only, any requests for corrections, deletion or copies of data should be directed to the K2 Cloud customer (the data controller). End users should contact customer directly with any questions on the method in which their data is processed using the K2 Cloud solution.

CHANGES TO THIS PRIVACY STATEMENT

We review our privacy policy at least annually and may make changes to this privacy statement from time to time. If we make material changes to this privacy statement, we will notify you either by posting in a noticeable location on our website or by directly sending you a notification.
